Introduction. This End User License Agreement (“Agreement”) is a legal contract between you (“User”) and Nicholas Benoist / ATC.AI (“Licensor”) regarding use of the Traffic Call Practice application (“App”). By installing, accessing, or using the App, you agree to the terms. If you do not agree, do not use the App.
1. Grant of License.
1.1 Educational License – Licensor grants you a non-exclusive, non-transferable, revocable license to use the App for personal, academic, and training purposes only, free of charge.
1.2 Commercial/Institutional Use – Any use by aviation schools, training organizations, or commercial entities requires a separate written license agreement. Contact Licensor for details.
2. Restrictions. You may not: (a) copy, distribute, rent, lease, sell, sublicense, or transfer the App; (b) modify, reverse engineer, decompile, disassemble, or create derivative works; (c) use the App for real-world air traffic control operations; (d) circumvent or disable features enforcing license restrictions.
3. Ownership. The App is licensed, not sold. All rights, title, and interest in and to the App, including all intellectual property rights, remain with Licensor.
4. Disclaimer of Warranty. The App is provided “as is” and “as available,” without warranties of any kind, express or implied. Licensor does not guarantee the App will be error-free, uninterrupted, or meet your training needs.
5. Limitation of Liability. To the maximum extent permitted by law, Licensor shall not be liable for any damages, including direct, indirect, incidental, consequential, or special damages, arising out of or related to use or inability to use the App.
6. Privacy. The App does not collect, store, or transmit personal data. If future versions implement data collection or voice recognition, a separate Privacy Policy will apply.
7. Updates and Termination. Licensor may modify, suspend, or discontinue the App at any time without notice. This Agreement terminates automatically if you violate its terms. Upon termination you must cease all use.
8. Governing Law. This Agreement is governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles.
9. Entire Agreement. This Agreement constitutes the entire agreement between you and Licensor concerning the App and supersedes all prior or contemporaneous understandings.
Acknowledgment. By using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
